1. Acceptance of Terms

By accessing or using OpsCurb ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

OpsCurb is an AWS cost optimization platform that:

Scans your AWS infrastructure for cost-saving opportunities
Provides recommendations for reducing cloud spending
Sends alerts and reports about wasteful resources
Offers AI-powered explanations and fix instructions

Important: OpsCurb is a read-only service. We do not modify your AWS resources.

3. Account Registration

3.1 Eligibility

You must be at least 18 years old
You must provide accurate and complete information
You must be authorized to bind your organization (if applicable)

3.2 Account Security

You're responsible for maintaining account security
You must use a strong password and enable MFA
You must notify us immediately of unauthorized access
You're responsible for all activities under your account

3.3 Account Types

Individual: Personal use only
Business: Commercial use with team members
Enterprise: Custom agreements available

4. AWS Account Connection

4.1 IAM Role Setup

You must create an IAM role in your AWS account that grants OpsCurb read-only access. You can use:

Our Terraform template (recommended)
Our CloudFormation template
Manual IAM role creation

4.2 External ID

You must use a unique External ID for security. Never share your External ID with anyone except OpsCurb.

4.3 Permissions

The IAM role must have only the permissions specified in our documentation. Do not grant additional permissions.

4.4 Your Responsibilities

You're responsible for the accuracy of your AWS configuration
You must keep your IAM role active for scanning to work
You must notify us if you revoke access
You're responsible for implementing our recommendations

5. Subscription Plans and Billing

5.1 Plans

Free: Limited features, 90-day data retention
Starter: $29/month, basic AI features
Pro: $99/month, advanced AI, custom models
Enterprise: Custom pricing, dedicated support

5.2 Payment

Payments processed via Stripe
Subscriptions renew automatically
Prices subject to change with 30 days notice
All fees are non-refundable except as required by law

5.3 Free Trial

14-day free trial for paid plans
No credit card required for Free plan
Trial converts to paid plan unless cancelled

5.4 Cancellation

Cancel anytime from your account settings
Access continues until end of billing period
Data retained for 30 days after cancellation
No refunds for partial months

6. Acceptable Use

6.1 Permitted Use

Scan your own AWS accounts
Scan customer accounts with proper authorization
Use recommendations to optimize costs
Share reports within your organization

6.2 Prohibited Use

You may NOT:

❌ Violate any laws or regulations
❌ Scan AWS accounts without authorization
❌ Reverse engineer or copy our service
❌ Resell or redistribute our service
❌ Use the service to harm others
❌ Attempt to bypass security measures
❌ Overload our systems (rate limits apply)
❌ Share your account credentials

6.3 Rate Limits

API: 1000 requests/hour (Free), 10,000/hour (Paid)
Scans: 10/day (Free), unlimited (Paid)
AI Explanations: 50/month (Starter), 500/month (Pro), unlimited (Enterprise)

7. Intellectual Property

7.1 Our IP

OpsCurb owns all rights to the Service
Our code, algorithms, and UI are proprietary
Our trademarks and logos are protected
You may not use our IP without permission

7.2 Your Data

You retain all rights to your AWS data
You grant us a license to process your data to provide the Service
We may use anonymized, aggregated data for analytics
You can export or delete your data anytime

7.3 Feedback

If you provide feedback or suggestions, we may use them without obligation or compensation.

8. Service Availability

8.1 Uptime

We target 99.9% uptime for paid plans

Free plan has no uptime guarantee

8.2 Maintenance

Scheduled maintenance announced 48 hours in advance
Emergency maintenance may occur without notice
We'll minimize disruption whenever possible

8.3 Service Changes

We may modify features at any time
We'll notify you of significant changes
Continued use constitutes acceptance

9. Data and Privacy

9.1 Data Collection

We collect data as described in our Privacy Policy.

9.2 Data Security

We implement industry-standard security measures. See SECURITY.md.

9.3 Data Retention

Scan results: 90 days (Free), 1 year (Paid)
Account data: Until deletion
Backups: 30 days

9.4 Data Deletion

You can request data deletion at any time. We'll delete within 30 days.

10. Warranties and Disclaimers

10.1 Service "AS IS"

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

10.2 No Guarantee of Savings

We provide recommendations, not guarantees
Actual savings may vary
You're responsible for implementing recommendations
We're not liable for AWS charges

10.3 Accuracy

We strive for accuracy but don't guarantee it
AWS data may be delayed or incomplete
You should verify recommendations before implementing

10.4 Third-Party Services

We're not responsible for AWS, Stripe, or other third-party services
Third-party terms apply to their services

11. Limitation of Liability

11.1 Maximum Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE LAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

11.2 Excluded Damages

WE'RE NOT LIABLE FOR:

Indirect, incidental, or consequential damages
Lost profits or revenue
Data loss (you should backup your data)
Service interruptions
Third-party actions

11.3 Exceptions

Some jurisdictions don't allow liability limitations. In those cases, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

Your use of the Service
Your violation of these Terms
Your violation of third-party rights
Your AWS account or data

13. Termination

13.1 By You

Cancel anytime from account settings
Data retained for 30 days after cancellation

13.2 By Us

We may suspend or terminate your account if:

You violate these Terms
You don't pay fees
You engage in fraudulent activity
Required by law

13.3 Effect of Termination

Access to Service ends immediately
Outstanding fees remain due
Data deleted after retention period
These Terms survive termination where applicable

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law provisions.

14.2 Arbitration

Disputes shall be resolved through binding arbitration, except:

Small claims court disputes
Intellectual property disputes
Injunctive relief

14.3 Class Action Waiver

You agree to resolve disputes individually, not as part of a class action.

These Terms constitute the entire agreement between you and OpsCurb.

15.2 Modifications

We may modify these Terms at any time. We'll notify you of material changes. Continued use constitutes acceptance.

15.3 Severability

If any provision is unenforceable, the remaining provisions remain in effect.

15.4 No Waiver

Our failure to enforce a right doesn't waive that right.

15.5 Assignment

You may not assign these Terms. We may assign to a successor or affiliate.

15.6 Force Majeure

We're not liable for delays due to circumstances beyond our control.
